1. Overview
This website and online store are operated under the trade name Kaelix ("Kaelix," "we," "us," or "our"). By visiting our site or purchasing from us, you agree to these Terms of Service ("Terms"), our Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree, please do not use the site.

2. Eligibility
You must be at least 18 years old and capable of entering into a binding contract. Our products are sold for delivery within the United States only.

3. Products
We try to display our products and their colors as accurately as possible, but we cannot guarantee that your screen will show them exactly. We reserve the right to limit quantities, discontinue products, or refuse any order. The KAELIX Ergonomic Chair is designed for comfort and support but is not a medical device, and nothing on this site is medical advice. Consult a healthcare professional regarding any medical or physical condition. Assemble and use the chair according to the provided instructions.

4. Pricing, payment, and taxes
Prices are in U.S. dollars and may change without notice. Applicable sales taxes are calculated at checkout through Shopify Tax. You agree to provide accurate and complete payment information and confirm that you are authorized to use the payment method. We reserve the right to cancel and refund any order in case of pricing errors, suspected fraud, or unavailability.

5. Shipping and returns
Shipping and returns are governed by our Shipping Policy and Refund Policy, which are part of these Terms.

6. Limited Warranty
What is covered. For one (1) year from the delivery date, the KAELIX Ergonomic Chair is covered against manufacturing defects and production-related technical problems affecting the chair and its components. This Limited Warranty is provided by Kaelix and is backed by the manufacturer.
Remedy. If a covered defect is confirmed, we will, at our option, repair the chair, replace the defective component or the chair, or refund your purchase price.
What is not covered. This Limited Warranty does not cover: damage caused by misuse, abuse, accident, neglect, improper assembly, unauthorized modification or repair, or use contrary to the instructions; normal wear and tear; and change of mind, which is handled under our 30-Day Money-Back Guarantee.
How to make a claim. Email Kaelix.support.team@gmail.com with your order number, a description of the issue, and detailed photos and/or a short video. Our team will determine whether the issue is related to manufacturing or production. For urgent product support, call +1 581-443-2803 (call charges may apply).
Implied warranties. To the fullest extent permitted by law, any implied warranties, including merchantability and fitness for a particular purpose, are limited in duration to the one-year duration of this Limited Warranty. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This Limited Warranty gives you specific legal rights, and you may also have other rights that vary by state.

7. Use of the site
You agree not to use the site for any unlawful purpose, to interfere with its operation, to attempt unauthorized access, to transmit malicious code, or to scrape or copy its content. We may suspend or terminate access at any time for violations of these Terms.

8. Intellectual property
All content on this site, including text, images, logos, and design, is owned by or licensed to Kaelix and is protected by intellectual property laws. You may not reproduce or use it without our written permission.

9. Reviews and communications
If you submit reviews or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and reproduce it. You confirm it is truthful, lawful, and does not infringe anyone's rights. We may remove any content at our discretion.

10. Third-party links and services
The site may link to or rely on third-party services, such as Shopify and payment processors. We are not responsible for third-party sites or services.

11. Disclaimer of warranties
Except for the Limited Warranty above, and to the fullest extent permitted by law, the site and our products are provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the site will be uninterrupted or error-free.

12. Limitation of liability
To the fullest extent permitted by law, Kaelix will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or use, arising out of your use of the site or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification
You agree to indemnify and hold harmless Kaelix from any claim, loss, or expense, including reasonable legal fees, arising from your breach of these Terms or your misuse of the products or site.

14. Dispute resolution and arbitration — please read carefully
Informal resolution. Before starting any formal proceeding, you agree to contact us at Kaelix.support.team@gmail.com and give us 30 days to try to resolve the dispute.
Binding arbitration. If we cannot resolve it, any dispute, claim, or controversy arising out of or relating to these Terms, the site, or our products will be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this agreement to arbitrate. Arbitration may be conducted by videoconference, telephone, or written submissions, so that neither party is required to travel.
No class actions. You and Kaelix agree to resolve disputes only on an individual basis. Neither party may bring or participate in a class, collective, consolidated, or representative action. If this waiver is found unenforceable for a claim, that claim will proceed in court and not in arbitration.
Jury trial waiver. To the extent permitted by law, you and Kaelix waive any right to a jury trial.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies.
Opt-out. You may opt out of arbitration by emailing Kaelix.support.team@gmail.com within 30 days of your first purchase, with your name and order number and a statement that you opt out.

15. Governing law and venue
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the agreement to arbitrate. For any claim not subject to arbitration, you agree to the exclusive jurisdiction of the courts of the Province of Quebec, Canada, to the extent permitted by law.

16. General
Changes. We may update these Terms at any time by posting the revised version on this site. Your continued use of the site means you accept the changes.
Severability. If any provision is found unenforceable, the rest remains in effect.
Entire agreement. These Terms, together with our policies, are the entire agreement between you and Kaelix.
No waiver. Our failure to enforce a provision is not a waiver of it.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
Electronic communications. You consent to receive communications from us electronically.
